IL&T Introduces Penalty Point System (ERRU Register) for Tachograph Violators

The IL&T applies a penalty point system for digital tachograph infringements since 1 April 2021

The Dutch Transport and Environment Inspectorate has implemented a penalty point system as of April 1, 2021 for serious tachograph violations by transport companies in the Netherlands and throughout the European Union.

Consequences for Reliability Status

Transport companies require an EU road transport licence to conduct their operations. A prerequisite is that the transport operator and transport manager are trustworthy — they can demonstrate this with a Certificate of Good Conduct (VOG). Through the penalty point system, transport companies can lose their reliability status and, consequently, their licence if they exceed the threshold. This applies to violations in the Netherlands and in other EU member states. With the European Register of Road Transport Undertakings (ERRU), European countries can exchange violation information with one another.

Penalty Threshold

A maximum penalty point limit is set for transport companies: the threshold. The level depends on the size of the company. If exceeded, the IL&T conducts a reliability investigation aimed at potentially restoring confidence. Violations abroad are registered in the national electronic register (ERRU). Companies receive notification at the first registered violation and when they reach half of the threshold. Transport undertakings can view their penalty point totals with the NIWO; bus companies can check with the IL&T.

Foreign Transport Operators

In addition to issuing fines, the IL&T registers violations committed by foreign transport companies in the Netherlands. This enables other EU member states to take action against those companies in accordance with their own legislation. This is part of European regulations to harmonize enforcement in goods and bus transport.
