Driving and Rest Time Checks Tightened by IL&T

The Dutch Transport and Environment Inspectorate has tightened its inspection points for driving and rest times since February 1st. According to the IL&T, entrepreneurs and drivers continue to violate the law and attempt to circumvent it in various ways.

Changes Since February 1st

With these changes, the probability of detection at roadside checks has increased considerably. The changes concern inspections of driving and rest times, confiscation of driver cards, and company inspections.

Driving and Rest Time Inspection

Drivers are required to take daily rest of 11 consecutive hours and weekly rest of 45 hours. Before the changes, the IL&T looked at violations from the last daily rest taken during a roadside check and only issued on-the-spot fines. Since February 1st, the IL&T inspects from the last weekly rest period taken.

Driver Card Confiscation

Manipulation results in substantial fines: EUR 10,375 for the transport company and EUR 1,500 for the driver. However, this proved insufficient. Drivers caught red-handed committing technical manipulation now risk confiscation of their driver card, which prevents them from driving in vehicles equipped with digital tachographs.

Company Inspections

Previously, only the employer was fined in cases of fraud during company inspections. From February 1st, the driver also faces a fine of EUR 1,500 if he played a prominent role in the manipulation. The IL&T expects this will make drivers less willing to participate in fraud and more likely to report violations.
